Article 1 - Definitions In these terms and conditions, the following definitions apply:

Supplementary Agreement: an agreement whereby the consumer acquires products, digital content, and/or services in connection with a distance agreement, and these goods, digital content, and/or services are provided by Femano or by a third party based on an arrangement between that third party and Femano;

Reflection Period: the period within which the consumer may exercise their right of withdrawal;

Consumer: the natural person who acts for purposes unrelated to their trade, business, craft, or professional activity;

Day: calendar day;

Digital Content: data produced and delivered in digital form;

Continuing Performance Agreement: an agreement for regular delivery of products, services, and/or digital content during a certain period;

Durable Medium: any tool, including email, that allows the consumer or Femano to store information addressed personally to them in a way accessible for future consultation and unaltered reproduction;

Right of Withdrawal: the consumer’s ability to withdraw from the distance agreement within the reflection period;

Distance Agreement: an agreement between Femano and the consumer under an organized system for distance selling of products, digital content, and/or services, where up to and including the conclusion of the agreement exclusive or partial use is made of one or more techniques for distance communication;

Model Withdrawal Form: the European model withdrawal form provided in Annex I to these terms;

Femano: the legal entity as further defined in Article 2, offering products, digital content access, and/or services remotely to consumers as described in these general terms;

Distance Communication Technique: means used to conclude an agreement without the consumer and entrepreneur meeting simultaneously in the same location.

Article 3 – Applicability

These general terms apply to every offer by Femano and every distance agreement concluded between Femano and the consumer.

Before concluding a distance agreement, the consumer is provided access to the text of these general terms.

If the distance agreement is concluded electronically, the text of these terms will be electronically accessible for storage on a durable medium.

If specific product or service conditions apply alongside these general terms, the consumer may invoke whichever provision is most favorable in the event of contradictory conditions.
Article 4 – The Offer

Offers limited in validity or subject to conditions explicitly state these limitations.

Offers contain complete and accurate descriptions of products, digital content, and/or services. Images are truthful representations. Apparent errors or mistakes are non-binding.

Offers clearly indicate the rights and obligations associated with acceptance.
Article 5 – The Agreement

Subject to paragraph 4, the agreement is concluded upon consumer acceptance and meeting stipulated conditions.

Electronic acceptance of an offer is immediately electronically confirmed by Femano.

Femano ensures secure data transmission and a safe web environment.

Femano may verify the consumer’s payment ability, with the right to refuse or impose conditions on the order.

Femano provides essential agreement details upon product/service delivery in an accessible form on a durable medium.

For continuing transactions, paragraph 5 applies only to the initial delivery.
Article 6 – Right of Withdrawal

The consumer may withdraw from a purchase within 14 days without giving reasons.

The reflection period begins the day after product receipt or contract conclusion.
Article 7 – Obligations of the Consumer during the Reflection Period

Consumers must carefully handle products during the reflection period, inspecting them only as they would in a store.

Consumers are liable only for diminished product value resulting from excessive handling.
Article 8 – Exercise of the Right of Withdrawal by the Consumer

Withdrawal must be communicated clearly within the reflection period.

Consumers must return products within 14 days of withdrawal notification, bearing direct return costs unless Femano agrees otherwise.
Article 9 – Femano’s Obligations upon Withdrawal
Femano refunds all payments including delivery costs within 14 days of receiving the withdrawal notice, using the same payment method unless agreed otherwise.
Article 10 – Exclusion of Withdrawal Rights
Certain products/services clearly identified by Femano may be exempted from withdrawal rights, including customized items and sealed health/hygiene products opened after delivery.
Article 11 – Price
Prices remain fixed during an offer’s validity unless changes result from VAT adjustments or market fluctuations clearly communicated.
Article 12 – Fulfillment and Extra Guarantee
Femano guarantees conformity with agreement terms and statutory requirements. Any extra guarantees provided are supplementary to consumer statutory rights.
Article 13 – Delivery and Execution
Femano delivers orders within 30 days unless otherwise agreed. Delays entitle consumers to contract termination and possible compensation.
Article 14 – Continuing Transactions:
Duration, Cancellation, Renewal Consumers may terminate ongoing agreements anytime with notice periods not exceeding one month. Automatic renewals are limited and clearly regulated.
Article 15 – Payment
Payment terms require consumers to fulfill obligations within 14 days after the reflection period or agreement conclusion. Late payments incur statutory interest and collection costs.
Article 16 – Complaints
Procedure Femano provides a clear complaints process, responding within 14 days of receipt.
Article 17 – Disputes
English law governs disputes, handled by the competent court in Femano’s district.
Article 18 – Additional or Deviating Provisions
Additional or deviating terms must benefit consumers and be clearly documented in writing or accessible durable media.
